Terms & Conditions

These Terms & Conditions (“Terms”) are a binding agreement between you and InvestArt Ltd (“InvestArt”, “we”, “us”, “our”) and govern your access to and use of investartco.com and any related services (the “Site”). By using the Site or submitting an enquiry, you accept these Terms.

1. About us

InvestArt Ltd is a company registered in England and Wales. We introduce prospective collectors to fine art available for private acquisition. InvestArt Ltd is not authorised or regulated by the Financial Conduct Authority in relation to the sale of artwork.

2. Nature of the Site

The artworks featured on the Site are offered as collectible fine art and are not regulated financial products. Nothing on the Site constitutes financial, investment, legal or tax advice, or a recommendation to acquire any artwork. Any references to potential value or appreciation are provided for general informational purposes only. The value of art may rise or fall and past performance or historical appreciation does not guarantee future value.

3. Enquiries

Submitting an enquiry through the Site (including via the multi-step lead form or the “Speak to a Specialist” pop-up) is not an offer to buy or sell any artwork and does not create any binding obligation. Any acquisition of an artwork will be subject to a separate written agreement.

4. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site or submit an enquiry.

5. Licence and permitted use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Site for personal, non-commercial use. You agree not to (a) copy, reproduce, scrape or systematically extract content from the Site; (b) use the Site to compete with us; (c) attempt to interfere with the security or operation of the Site; or (d) use any information on the Site for commercial appraisal, valuation, lending or insurance purposes without our prior written consent.

6. Intellectual property

All content on the Site — including text, images, graphics, logos, video and the InvestArt name and marks — is owned by or licensed to InvestArt and is protected by UK and international copyright, trademark and other intellectual property laws.

7. Third-party content

The Site may contain references to third parties, publications or artworks. Such references are for information only and do not imply endorsement.

8. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all representations, warranties and conditions, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement.

9. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under English law. Subject to that, to the fullest extent permitted by law we will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, business, goodwill, data or opportunity, arising out of or in connection with your use of the Site.

10. Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any applicable law or third-party right.

11. Privacy and cookies

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

12. Changes

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance.

13. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction.
